Service Description

Massachusetts Pest Control provides professional pest management and extermination services to residential and commercial customers throughout the Commonwealth of Massachusetts. Our services include inspection, identification, treatment, and ongoing monitoring for common pests including but not limited to rodents, insects, termites, bed bugs, ants, cockroaches, wasps, bees, mosquitoes, ticks, and wildlife. Treatment methods vary based on pest type, infestation severity, property conditions, and applicable regulations, and may include chemical applications, baiting systems, trapping, exclusion techniques, and integrated pest management approaches. Service schedules, treatment plans, and pricing are determined following an initial inspection and assessment of the premises. All services are performed by licensed technicians in accordance with Massachusetts pesticide application laws and regulations. We reserve the right to modify treatment protocols based on environmental conditions, regulatory changes, or technician professional judgment.

No Guarantee or Warranty

Massachusetts Pest Control makes no express or implied guarantees regarding the complete elimination of pests from any treated property. Pest control results depend on numerous factors beyond our reasonable control, including but not limited to: neighboring infestations, structural conditions of the building, occupant behavior, environmental factors, weather conditions, re-infestation from external sources, and compliance with preparation and follow-up instructions. We do not warrant that treatments will prevent future infestations or that treated areas will remain pest-free for any specific duration. Any stated service warranties, if applicable, are limited to retreatment of the specific treated area within the defined warranty period and do not include refunds or compensation for damages. Our maximum obligation for any service issue is limited to re-performing the specific treatment at no additional cost, at our sole discretion.

User Responsibilities

Customers must provide accurate information regarding pest sightings, property conditions, previous treatments, and known allergies or sensitivities of occupants or pets. Prior to scheduled service, customers are responsible for preparing the premises as instructed, which may include cleaning, removing clutter, storing food and utensils, securing pets, vacating the premises during and for specified periods after treatment, and providing access to all relevant areas including basements, attics, crawl spaces, and exterior perimeters. Customers must notify us of any changes in property conditions, new construction, or pest activity between scheduled services. Failure to follow preparation instructions, interference with treatment applications, or withholding relevant information may void any service warranty and may result in additional charges for repeat visits. Customers are responsible for maintaining the property in a manner that does not encourage pest harborage, including proper sanitation, sealing entry points, and addressing moisture issues.

Limitation of Liability

To the fullest extent permitted by law, Massachusetts Pest Control and its owners, employees, agents, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to property damage, personal injury, allergic reactions, loss of use, loss of profits, or emotional distress. Our total cumulative liability for any claim shall not exceed the total amount actually paid by the customer for the specific service giving rise to the claim. We are not liable for damage to personal property, vegetation, or structures resulting from necessary treatment applications, nor for pest-related damages occurring before, during, or after service. Customers assume all risk of property damage or personal injury related to pest presence or treatment activities. This limitation applies regardless of the legal theory asserted, including negligence, breach of contract, strict liability, or otherwise.

Intellectual Property

All content, materials, trademarks, service marks, logos, trade names, and intellectual property displayed on our website, marketing materials, service reports, and documentation are the exclusive property of Massachusetts Pest Control or its licensors. Customers and website visitors may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our intellectual property without prior written consent. Service reports and documentation provided to customers are for their personal, non-commercial reference only and may not be transferred, sold, or used to obtain services from competing providers. Unauthorized use of our intellectual property may result in civil and criminal penalties under applicable federal and state laws.

Governing Law

These Terms of Service and any disputes arising from or related to our services shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal action, proceeding, or dispute resolution shall be brought exclusively in the state or federal courts located within Massachusetts, and customers irrevocably consent to the personal jurisdiction and venue of such courts. These terms are subject to all applicable Massachusetts consumer protection laws, pesticide application regulations, and licensing requirements. If any provision of these terms is found invalid or unenforceable under Massachusetts law, the remaining provisions shall continue in full force and effect.

Changes to Terms

Massachusetts Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Changes become effective immediately upon posting to our website or other notification methods. Customers are responsible for reviewing these terms periodically. Continued use of our services following any changes constitutes acceptance of the modified terms. We encourage customers to retain copies of these terms for their records. The version in effect at the time services are rendered shall govern that specific service agreement.
